Collaborative Family Lawyers in Inverness

Collaborative law is a cheaper and less stressful alternative to divorce litigation that can be used by separated couples to determine issues such as property, childcare and finances. Essentially, parties commit to discuss matters and agree upon a mutually acceptable resolution. As the process is voluntary and, unlike court proceedings, aimed at collaborative problem solving, it has the potential to result in long-term solutions.

Family Law Dispute Resolution

The process takes the form of a series of four-way face-to-face meetings between the parties and their solicitors. There is an emphasis on the parties remaining in control of the process. They will share their own central objectives and set the agenda for the subsequent meetings.

The process is non-confrontational and, to achieve an agreement, all concerned must engage in constructive negotiations, disclose all the required information in good faith and keep any children they have at the heart of their discussions. In the further meetings, parties will discuss their particular priorities and concerns, such as children and finances.

The parties’ solicitors will help them to examine all sides of an issue, provide advice and support and proactively guide the parties to work as a team to resolve their issues. At the final meeting, their issues will hopefully be resolved and a written Agreement can be drawn up.
